No modification or amendment to this agreement shall be of any force or effect unless in writing executed by the customer and authorized representative(s) of seller. This agreement is not assignable by the customer without the prior written consent of seller.
Price Protection
Please note: oxiostyle.com doesn't offer price protection. (Due to nature of our business Price you pay today may be different tomorrow). All specials and promotions limited to stock on hand. Call for current prices. Not responsible for typographical errors. We reserve the right to limit quantities on all products.
Retail Customers
Please note: Prices on oxiostyle.com are applicable only for purchases online. Prices in our retail location are not associated with our prices on our Web site, and are subject to the pricing policies established in the retail store
Cancellation
Please note: Canceling any order paid by credit card prior to shipping the merchandise will incur a 3% credit card charge. That same fee will be assigned to any order cancelled after having been charged. When an order is placed and credit card information given, it is considered to be a solid order and your credit card will get charged unless the merchandise is not in stock.
Errors and Omissions
oxiostyle.com makes every effort to ensure the accuracy of the information published in our catalogs and on our Web site(s). However, the documents and graphics published on this site may contain technical inaccuracies or typographical errors. oxiostyle.com makes no representations about the suitability of the information and graphics presented on this site. If an error is made and a product is listed at an incorrect price, oxiostyle.com shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to your credit card, oxiostyle.com shall immediately issue a credit in the amount of the incorrect price.

Force Majeure
oxiostyle.com shall not be responsible for delays or failures in performance and shall have no liability to purchaser resulting from causes beyond its reasonable control, including but not be limited to acts of God, natural disasters, war, riot, fire, accident, explosion, strikes, or other labor trouble, government acts or omissions, delay or default by subcontractors or suppliers of materials or services, transportation difficulty or shortages in labor, fuel, materials, suppliers, or power at current prices. oxiostyle.com is not liable for any delay in performance due to unforeseen circumstances or due to cause beyond its control including, but not limited to, acts of government, labor disputes, delay in transportation, and delays in delivery or inability to deliver by oxiostyle.com supplier.
We are not liable under any legal theory for consequential or incidental damages arising from shipping delays, system downtime, loss of data or for any loss, damage, or expense arising from product malfunction or defect. We expressly disclaim all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. This disclaimer in no way affects the terms of the manufacturer’s warranty, if any. Other restrictions may apply.
Indemnity
Customer shall indemnify oxiostyle.com against and hold seller harmless from any an all claims, actions, proceedings, expenses, damages or liabilities including attorney's fees, arising in connection with the equipment, including, without limitations, its manufacture, selection, purchase, delivery, possession, use, operation or return and the recovery of claims under insurance policies thereon.
Legal
In the event it becomes necessary for seller to enforce the terms and conditions of the agreement including seller's disclaimers and limitations of liability, seller shall be entitled to recover all of its costs incurred including reasonable attorney's fees in all manner of collection and in trail and appellate levels. In case of legal action customer is responsible for legal fees, lost of time to collect, all other expenses, and 10% annually interest to collect balance for an invoice or invoices.
Receive Damaged Merchandise
If you receive damaged merchandise, it is best to REFUSE it back to the carrier attempting delivery. If you accept the package make sure it is noted on the carrier's delivery record in order for oxiostyle.com to file a damage claim. Save the merchandise and the original box and packing it arrived in, notify oxiostyle.com immediately to arrange for a carrier inspection and a pick up of damaged merchandise. For your protection, we strongly recommend you fully insure your return shipment in case of loss or damage. Please use a carrier that is able to provide you with proof of delivery such as UPS or Fed Ex.
Remedies Upon Default
Failure of customer to perform its obligations hereunder including, without limitation payment in full of the purchase price for the equipment or the insolvency, bankruptcy, assignment for the benefit of creditors, or dissolution, liquidation, or winding up of the business of customer shall constitute a default under this agreement, and shall afford to seller the right to immediately recover the equipment without notice to the customer in addition to all the remedies of a secured party under the uniform commercial code of the state of New York.
Return Check
In case customer’s check is not cleared for any reason or check is stopped for payment. oxiostyle.com is authorized to charge customer’s credit card, that we have obtained for any reason in past, plus credit card charges in addition to $20 handling fee for each bounced or stopped check.
Shipment Refusal
Purchaser refusal to accept shipment of Goods from freight carrier for any reasons beyond the control of oxiostyle.com will incur a credit of *Current Price less a restocking charge of 15% of the invoice price and all freight charges (including loss or charges) Subsequent purchases will require written purchase order.
Shipping information
After placing your order you will receive confirmation e-mail with details of the order you just placed. Customer is solely responsible for applicable shipping and handling charges and taxes. Unless Customer provides oxiostyle.com with a valid government or nonprofit tax exemption certificate, taxes will be charged for orders shipped to New York state in which oxiostyle.com is obligated to collect and report such sales.
oxiostyle.com have chosen FedEx or UPS because we have found that the service and reliability is worth the difference in price. If the website is calculating an unusually high shipping rate in comparison to the amount or type of items that you are ordering, you can call us directly at 212-997-8998 or email us cs@dotredny.com
Note: Credit Card Orders Only! If the shipping address is different from the billing address on your credit card, please call your credit card company and have them note the shipping address on the card. However, there may be a delay in processing your order for verification purposes.
Shipping Policy
For your convenience, we use the most reliable carriers suitable to your location to deliver your package in the shortest time. Shipping charges are automatically calculated based on your selected method of shipment when placing an order. The method of shipment you choose does not necessarily mean you will receive your order within the specified number of days. Please note that we count from the day we ship and not from the day you place your order. However, we guarantee that we attend to our customers on a first come first serve basis. Please take note that we do not ship on Saturdays, Sundays and Holidays. Orders placed after 10 a.m. EST Friday will ship the following Monday. We do not ship to P.O boxes, military APO/FPO addresses or particular international locations at this moment.
Will I be charged tax?
Sales tax applies only to shipping addresses located in New York.
Shortage
Shortages must be claimed within twenty four (24) hours of the time merchandise is received by customer.
Shipment of any products purchased are subject to oxiostyle.com availability schedule. oxiostyle.com shall make every reasonable effort to meet any delivery date(s) quoted or acknowledged. However, oxiostyle.com will not be liable for its failure to meet such date(s).
Warranty
All items have carry-in warranty unless specified otherwise. Carry-in means that customer shall bring item(s) to oxiostyle.com for repair regardless of amount and date of purchase. Do not discard boxes and packing materials. Some items must be shipped to us for purpose of warranty or non-warranty repair. It is best to ship them inside their original boxes. Warranty shall not apply to defects resulting from: Improper or inadequate maintenance by buyer or unauthorized modification or misuse.
